End User License Agreement

1. License Grant

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use on devices owned or controlled by you.

1.1 Age Requirements

You must be at least 13 years of age to use this App. Users under 18 have access to a restricted feature set as described below.

1.2 Parental Consent

If you are between 13 and 17 years of age:

• Your parent or legal guardian must have reviewed and agreed to this Agreement
• In-app purchases require parental approval through Apple's Family Sharing controls
• Parents can control age sharing and app access through device settings

2. Restrictions

You agree not to:

1. Decompile, reverse engineer, disassemble, or attempt to derive the source code of the App.
2. Modify, adapt, or create derivative works of the App.
3. Use the App for any illegal or unauthorized purpose.
4. Use the App to harass, abuse, stalk, threaten, or defame others.
5. Use the App to generate content that is hate speech, sexually explicit, or promotes violence.

3. User Content & AI Interactions

Ownership

You retain ownership of the journal entries and content you create in the App.

AI Limitations

The App uses Artificial Intelligence (AI) to provide insights and chat features. You acknowledge that:

• AI responses are generated automatically and may not always be accurate.
• The App is not a substitute for professional medical, psychological, or therapeutic advice.
• Always seek the advice of a qualified health provider with any questions you may have regarding a medical condition or mental health.
• We are not liable for any actions you take based on AI-generated advice.

Third-Party AI Services

AI features may utilize third-party services including OpenAI, Anthropic, Google Gemini, and OpenRouter. By using AI features, you agree to the terms of service of these providers:

• OpenRouter: Some AI requests are routed through OpenRouter, an LLM aggregator. OpenRouter does not store your prompts unless you explicitly opt in. See OpenRouter Terms and Privacy Policy.

4. Subscription & Payments

Subscriptions

Eristotle offers auto-renewing subscriptions (Monthly/Annual) processed via the Apple App Store.

Billing

Payment will be charged to your Apple ID account at confirmation of purchase.

Renewal

Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period.

Cancellation

You can manage and cancel your subscriptions in your App Store Account Settings.

5. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into this Agreement by reference.

Key privacy highlights:

• Your journal entries are encrypted and stored securely
• We do not sell your personal data
• You can export or delete your data at any time
• BYOK users' API keys are stored in device Keychain and never sent to our servers

5.1 Children's Privacy (COPPA Compliance)

We comply with the Children's Online Privacy Protection Act (COPPA):

• Under 13: We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us immediately.
• Ages 13-17: Teen users have restricted access. We use Apple's Declared Age Range API to verify age without collecting birthdates.
• Parental Rights: Parents can review, delete, or restrict their child's data by contacting us or using device-level controls.

6. Termination

This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any term(s). Upon termination, you must cease all use of the App and delete all copies of the App.

What Happens Upon Termination

• Your license to use the App ends immediately
• You lose access to premium features
• Your data remains on your device unless you delete it
• Cloud-synced data can be deleted via account deletion

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

This means:

• We do not guarantee the App will be error-free or uninterrupted
• We do not guarantee the accuracy of AI-generated insights
• We do not guarantee compatibility with all devices or operating systems
• We do not guarantee that the App will meet your specific requirements

8. Limitation of Liability

TO THE EXTENT PERMITTED BY LAW, YOKII STUDIO LLC (AND ITS OFFICERS, EMPLOYEES, AND AGENTS) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

This includes, but is not limited to:

• Loss of data or content
• Loss of profits or revenue
• Emotional distress or mental health outcomes
• Actions taken based on AI recommendations
• Service interruptions or technical issues

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is established (State of California, United States), excluding its conflicts of law rules.
